Welcome to the website and online store of Milwaukee Sports and Social Foundation (“Foundation,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online store, event registrations, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. About the Foundation

Milwaukee Sports and Social Foundation is a registered 501(c)(3) public charity dedicated to strengthening Wisconsin communities through recreational green space development.

All purchases, registrations, and transactions made through the Services support our charitable mission.

2. Eligibility

You must be at least 18 years old to make purchases or register for events through the Services. If registering a minor for an event, you represent that you are the minor’s parent or legal guardian and have authority to agree to these Terms on their behalf.

3. Donations, Purchases, and Event Registrations

All purchases made through the Services, including but not limited to event registrations, tickets, and merchandise, support the Foundation’s charitable mission.

All sales are final and non-refundable, except as expressly stated in our Event Cancellation Policy.

The Foundation reserves the right to refuse or cancel any order or registration at its discretion.

4. Event Participation and Assumption of Risk

Participation in Foundation-sponsored events, including recreational or athletic activities, involves inherent risks, including but not limited to physical injury, property damage, illness, or other unforeseen circumstances.

By registering for or participating in an event, you voluntarily assume all risks associated with participation.

You agree that the Foundation, its officers, directors, volunteers, partners, and affiliates shall not be liable for any injury, loss, damage, or expense arising from participation in an event, except where prohibited by law.

Participants are responsible for determining their own physical fitness and ability to safely participate.

5. Event Changes and Cancellation

The Foundation reserves the right to cancel, postpone, or modify any event due to weather, safety concerns, venue issues, or other circumstances beyond its control.

If an event is postponed, registrations may be transferred to the rescheduled date. If an event is canceled and cannot be rescheduled, the Foundation will determine appropriate next steps consistent with its nonprofit mission.

6. Intellectual Property

All content on the Services, including text, graphics, logos, images, and branding, is the property of Milwaukee Sports and Social Foundation or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or use our content without prior written permission.

7. User Conduct

You agree not to:

Use the Services for unlawful purposes
Interfere with the security or operation of the Services
Submit false or misleading information
Attempt to gain unauthorized access to accounts or systems

We reserve the right to restrict or terminate access for violations of these Terms.

8. Third-Party Services

Our Services are hosted by Shopify and may include links to third-party websites. We are not responsible for the content, policies, or practices of third-party services.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available.” We make no warranties, express or implied, regarding the operation of the Services or the accuracy of information provided.

10. Limitation of Liability

To the fullest extent permitted by law, Milwaukee Sports and Social Foundation shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services or participation in Foundation events.

11. Indemnification

You agree to indemnify and hold harmless Milwaukee Sports and Social Foundation, its officers, directors, volunteers, partners, and affiliates from any claims, damages, or expenses arising out of your violation of these Terms or your participation in Foundation activities.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict of law principles.

We may update these Terms from time to time. Updated versions will be posted on this page with a revised “Last updated” date. Continued use of the Services constitutes acceptance of the updated Terms.
